Introduction and Scope of Services

Avelers.com is a unit of Paanap Connect Pvt Ltd based in India and Nepal ("Avelers"), operates a website under www.Avelers.com (including its social media channels and mobile applications, jointly the "Platform") where travel operators ("Operators") can offer, promote, market, and sell package tours to users and registered users of the Platform (the "Traveler" or "you"). Travelers can also use the Platform to evaluate and compare Operators and their tours, participate in competitions, write reviews, and enjoy other related offers (together "Avelers Services").

A) Terms of Use of the Platform

Avelers operates the Platform on which Operators can offer and market travel services such as multi-day tours, cruises, adventure trips, luxury travel, and other travel activities (individually or jointly "Travel Adventures").

Avelers Services are solely for persons who are aged 18 years or older. Any access to or use of the Platform by anyone under 18 years is expressly prohibited. By accessing or using the Services and the Platform, you guarantee that you are 18 years or older.

If you are acting on behalf of a company or another legal entity, you guarantee that you are legally entitled to accept these terms and conditions in their name.

Prohibited Conduct

Avelers Services are only available for private, non-commercial use. It is not allowed to sell, resell, reuse, or commercially use content, information, software, products, or services available on our Platform.

  • Further, it is prohibited to:
    • ● Use bots, crawlers, scrapers, or other automated means (besides authorized use of our API) to access or interact with the Platform or collect data or content not in connection with your booking.
    • ● Circumvent established security or technological barriers in place to protect the Platform and its content.
    • ● Decrypt, decompile, reverse engineer, or copy the website and Platform.
    • ● Otherwise compromise or damage the Platform and its proper functioning.
  • Content and Intellectual Property

    Avelers may, at its sole discretion, permit you to post, upload, publish, submit, or transmit text, graphics, images, videos, or other materials ("Content") on the Platform and through the Avelers Services. By making available any Content, you agree that Avelers may use the Content on the Platform, in particular for promotional materials and publications. You hereby grant Avelers a worldwide, irrevocable, perpetual, non-exclusive, royalty-free license to publicly display or otherwise use the Content for the aforementioned purpose. Avelers does not claim any ownership rights in any such Content, and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit the Content.

    You acknowledge and agree that you are solely responsible for all Content that you make available on the Platform or through the Avelers Services. Accordingly, you represent and warrant that:

    • (a) you either are the sole and exclusive owner of all Content or you have all rights, licenses, consents, and releases that are necessary to grant to Avelers the rights in such Content, as contemplated under these terms and conditions; and
    • (b) neither the Content nor your posting, uploading, publication, submission, or transmittal of the Content or Avelers' use of the Content (or any portion thereof) on, through, or by means of the Services will infringe, misappropriate, or violate a third party's patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
  • It is not allowed to upload or submit Content that:
    • (i) is illegal, pornographic, incites hate, obscene, or defamatory;
    • (ii) contains commercial content, especially advertisements or marketing for other goods or services;
    • (iii) infringes intellectual property rights of others;
    • (iv) contains viruses, malware, trojan horses, or other harmful files.

Avelers is not obliged to check any Content ex-ante. Content that violates this clause can be blocked or removed immediately without notice.

Termination: Avelers.com and its registered users may terminate the usage agreement at any time with immediate effect. To do so, please send us an email.

In the event of termination, Avelers.com is not obligated to delete or revert any content posted by the Traveler on the platform. The rights and obligations of existing Travel Adventures remain unaffected by such termination.

Terms for Travel Adventures – The Role of Avelers.com
The travel services provided to you are considered package deals under Directive (EU) 2015/2302. As such, you are entitled to all EU rights applicable to travel packages. The Operator is fully responsible for the proper execution of the package as a whole.

Additionally, as per legal requirements, the Operator must have protection in place to refund your payments and, if transportation is included, ensure your repatriation in the event of insolvency.

The Travel Adventures are independently created, offered, and executed by Operators at their own discretion and responsibility. Avelers.com solely acts as a commercial agent for these Operators. Avelers.com is not an Operator, provider of Travel Adventures, representative, proxy, or insurer. It does not own, sell, resell, furnish, provide, manage, or control any transportation, tour, or travel services and does not act as an agent for Travelers.

Avelers.com has no control over the conduct of Operators, Travelers, or other platform users. Travelers are responsible for ensuring they possess valid travel identification, including any necessary visas, and comply with health requirements such as vaccinations.

Contract Conclusion, Documents & Information
Travel Adventures are booked directly with the respective Operator. The Operator's terms and conditions apply.

By clicking "Book now," you submit a binding offer for the selected Travel Adventure to the Operator. The travel contract is established upon acceptance by the Operator. Avelers.com stores the contract text and booking data for processing purposes.

Operators confirm or reject booking requests within 10 to 24 hours, during which your offer remains binding. Once the booking is finalized (including any required payment), the Traveler receives a confirmation email summarizing the contract details.

For "on request" bookings, the Operator may take up to 5 business days to confirm availability. If the request is approved, you will be charged the full amount. If the Operator cannot confirm the request, you will receive a full refund.

Special requests are non-binding unless explicitly confirmed by the Operator. Avelers.com forwards such requests but does not guarantee fulfillment.

Traveler Responsibilities
Travelers must provide accurate and complete personal information when using Avelers.com services. They must disclose any relevant conditions (e.g., food intolerances, mobility restrictions, health issues) that may impact service provision.

Travelers booking for themselves or others assume responsibility for compliance with these terms and must inform fellow travelers of the same. Fraudulent, speculative, or false bookings are strictly prohibited.

Travelers must verify all contractual documents (e.g., booking confirmation, vouchers) and promptly report any errors. Special conditions apply to travelers with restricted mobility, medical needs, or pregnancy, who must inform Avelers.com at least 48 hours before departure.

Any contract breach should be reported immediately to the Operator for prompt resolution. Complaints should be submitted via Avelers.com's Booking Management Page.

Travelers are responsible for timely payment of all agreed fees and must notify Avelers.com of any claims for damages or refunds due to contract breaches.

Payments
Certain Operators may offer secure online payment options during the booking process. Avelers.com facilitates these payments via third-party processors, ensuring safe transactions.

Avelers.com may offer special payment options (e.g., installments) through designated providers. By accepting these options, you agree to the specified terms.

Once a booking is confirmed, the Operator’s cancellation and payment policies apply. Travelers should carefully review these policies before booking. Cancellations must be made through Avelers.com’s Booking Management Page.

Complaints related to Travel Adventures will be handled by Operators through Avelers.com’s platform.

Travel Insurance
Avelers.com strongly recommends the following travel insurance policies, which are not included in any Travel Adventure:

  • Travel cancellation insurance to cover financial risks in case of cancellation.
  • Travel interruption insurance for unexpected disruptions after departure.
  • Comprehensive health insurance.

Reward Programs
Referral Program: Avelers.com allows Travelers to invite friends who do not yet have an account. Friends receive discounts or travel credits upon making a qualified booking through the Traveler’s unique referral link.

Restrictions apply:

  • Affiliate program members cannot collect travel credits through referral links.
  • Travel credits are valid only if the Traveler maintains an active Avelers.com account.
  • Referral links cannot be shared on public forums or coupon sites.
  • Any suspected fraud may result in forfeiture of travel credits.
  • Travel credits are non-transferable and cannot be redeemed for cash.

Loyalty Program:
Avelers.com offers Travel Credits after each booking, based on Gross Booking Value (GBV):

  • GBV up to $5,000 earns $50 in credits.
  • GBV between $5,001-$10,000 earns $150 in credits.
  • GBV over $10,000 earns $250 in credits.

Travel credits can be used as discounts on future bookings but cannot exceed 5% of the GBV per booking.

Discretionary Credits & Promo Codes: Avelers.com may issue discretionary travel credits or promo codes, valid for a limited time. Promo codes cannot be combined with travel credits and expire within 30 days unless otherwise stated.

General Provisions

  • Liability: Avelers.com is not liable for slight negligence except in cases of fraud, personal injury, or statutory warranty obligations. It is not responsible for force majeure events (e.g., cybercrime, natural disasters, pandemics).
  • As an intermediary, Avelers.com is not liable for:
    • ● Operator performance under the travel contract.
    • ● Services beyond the booked Travel Adventure.
    • ● Additional services booked independently by Travelers.
    • ● Errors made by Travelers during booking.

Electronic Correspondence: Official notifications from Avelers.com will be sent to the email address associated with your account. Travelers must update their contact details promptly.

Contact & Complaints: Travelers may submit requests and complaints through Avelers.com, which will be forwarded to the relevant Operator.

Applicable Law & Jurisdiction: These terms are governed by Austrian law. Legal disputes shall be settled in Vienna, Austria. Consumers may also initiate legal proceedings in their country of residence.

Cancellation and Refunds

Cancellations
Our standard cancellation policy can be found in our Terms & Conditions. Each adventure on Avelers.com is operated by an independent tour provider, and cancellation policies may vary depending on the operator.

How do I cancel my adventure?
To cancel your adventure, visit your Booking Conversation Page by logging into your Avelers.com account or accessing the link in your booking confirmation email. Cancellation fees may apply based on the operator’s policy and Avelers.com’s Cancellation Policy. Some operators also offer the option to convert your booking into credit for future trips.

Modifying Your Booking
You have two options:

  • Credit for Future Trips (free): Keep your booking amount as credit for a future trip with the same operator. This option is available only for select operators and can be checked via your Booking Conversation Page under "Modify Booking."
  • Cancellation (fees may apply): Cancel your adventure, keeping in mind that full refunds are not guaranteed. Fees may apply as per the Terms & Conditions. All cancellations must be requested in writing via the "Modify Booking" section of your Booking Conversation Page.

Operator Changes
Operators may make changes to your adventure under two circumstances:

  • Re-routing: Itineraries may be adjusted to ensure traveler safety and smooth operations. The operator will communicate any changes directly.
  • Suspension: Operators reserve the right to suspend a trip if safety concerns arise. If this happens, the operator will provide alternative options.

Credit for Future Trips
If your booking is eligible for credit, we will notify you via your Booking Conversation Page. We are working with our operators to expand this option. If you have questions, contact our Travel Experts via your Booking Conversation Page or through your booking confirmation email.

Peace of Mind Program
Not all adventures qualify for this program. Check your tour page to see if your adventure offers Peace of Mind. If you choose to convert to Credit for Future Trips, note that the credit is only valid with the original operator.

  • If you convert before your final payment is due: You will receive credit for your initial payment, and no further charges will be made except on Flights and activities.
  • If you’re paying in installments: You will receive credit for the amount you have paid so far, and no future installments will be charged except on Flights and activities.

COVID-19 Policies

  • Face masks: Local regulations and operator guidelines will determine mask requirements. We recommend bringing your own masks.
  • Postponing your trip: You can postpone your adventure and receive credit through your Booking Conversation Page. If you need assistance, our Travel Experts are available 24/7.
  • Flexible rebooking options: Use the "Free Rebooking" filter when searching for adventures to find trips with flexible change policies.
  • Health screenings & testing: COVID-19 requirements vary by destination and operator. You may need to complete a health screening form before your trip. Travelers showing symptoms or testing positive for COVID-19 will not be allowed to join the trip until cleared by a medical professional.
  • Trip status: If your adventure is canceled by the operator, we will notify you via email. You can also check for updates on your Booking Conversation Page.
